Terms of Use — DataTranscribe

These Terms of Use ("Terms") govern your access to and use of datatranscribe.com and portal.datatranscribe.com (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old. By using the Service you represent that all information you provide is accurate and complete.

2. Account Registration

You are responsible for keeping your password confidential and for all activity under your account. Notify us at support if you suspect unauthorized use.

3. Service Description

DataTranscribe provides automated transcription via OpenAI Whisper. New accounts receive 2 free transcription minutes upon email confirmation. Purchased minutes do not expire and stack with your balance.

4. Acceptable Use

Do not upload illegal content, attempt to circumvent limits, use bots, or transmit malware. We may remove content and terminate accounts that violate this policy.

5. Your Content

You retain ownership of your files and transcripts. You grant us a limited license to process them solely to provide the Service. We do not train models on your content or sell it to third parties.

6. Data Retention

Uploaded media is deleted within 24 hours of transcription. Transcripts are retained 90 days then deleted. Contact us for earlier deletion.

7. Privacy

Your use is governed by our Privacy Policy, incorporated here by reference.

8. Payments and Refunds

Payments are processed by Stripe. All prices in USD. Credits are non-refundable except as required by law. If a job fails due to a Service error, minutes are returned automatically.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT TRANSCRIPTION RESULTS WILL BE ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS OR $10.

11. Modifications

We may revise these Terms. Material changes will be notified 14 days before taking effect. Continued use constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA.

13. Termination

Request account deletion by emailing support. Unused purchased credits are forfeited upon voluntary deletion.
